ANOTHER EXPERIENCE IN ARBITRATION.

The GFKK team in the persons of senior associate Michał de Abgaro Zachariasiewicz and partner Paweł Kamiński, in cooperation with an expert for time claims and member of the Association of Consulting Engineers and Appraisers (SIDiR), mgr inż. Mariusz Nowacki, at the request of the General Directorate for National Roads and Motorways prepared an expert opinion concerning the contractor's time claims and the probable date of completion of works under the road investment contract. The opinion was prepared for the purposes of an ongoing arbitration dispute and its authors were appointed to participate as expert witnesses at the hearing.
The combination of the expert's technical knowledge and the legal knowledge of the members of the GFKK team, makes an opinion submitted in the context of an arbitration dispute more likely to have its findings defended in confrontation with the legal teams of both parties. Also, it positively affects its ultimate reception by the arbitration tribunal panel. This, in turn, often determines the acceptance or rejection of certain claims and the final outcome of the dispute. The adopted formula for the opinion preparation should therefore be of interest to other participants in construction and investment proceedings, especially at the stage of disputes before arbitration tribunals and common courts.
Apart from the aforementioned experience, GFKK has also been involved, on the side of the public procurer, in two major arbitration disputes concerning one of the largest environmental infrastructure investments made in Poland in recent years. In both of those proceedings, GFKK is supported by the team of the Polish Attorney General's Office in a co-council formula. In addition to the aforementioned Michał de Abgaro Zachariasiewicz and Paweł Kamiński, the attorneys at law Jolanta-Aleksa Mróz and Sylwia Kowalska are also involved in handling of both proceedings.
